I'm just wondering, supposed you used a preexisting game engine to make a 99% original game, would that be legal to sell.
Example: You make a game using Grand Theft Auto 4. The story, sound effects, dialogue, cars, map, graphics, etc are all original work. The only stuff that is from the original game is the pedestrian walking animations, aiming mechanics, driving physics, and ragdoll physics.
Would this example be illegal to sell with intention to make profit from it?
Edit don_apple: topic moved from german to english section.

Das solltest Du mit einem Rechtsanwalt der auf das Gebiet spezialisiert ist besprechen. Nur er kann dir die richtige Auskunft geben.

English forum.
And no, you’re selling work of others without permission. Falls under multiple IP protection laws along with not being a very decent thing to do.

Not to mention.... it'll also be a death wish trying that with non other than Rockstar. By the time they get through with you. Rest in Peace

Copyright protections extend to all parts of a product not otherwise considered to be in the public domain, such as open source material. Your two options are to either seek permission from the copyright owner to use their materials (compensation may be demanded) or to reverse engineer from their product, but changing enough so that it falls outside of their defined intellectual property. But that second one is a fine line to walk.
